1. PROMOTION TIMING: Share Your Cold-EEZE® Sweepstakes (“Sweepstakes”) begins at 12:00:01 a.m. E.T. on September 15, 2008 and ends at 12:01:00 a.m. E.T. on February 28, 2009.

2. HOW TO ENTER: Visit www.coldeeze.com, click on the Sweepstakes link and fill in all required entry information, including the following Share Your Cold-EEZE winning phrase “Cold-EEZE is clinically proven to shorten your cold by nearly half”, to participate in the Sweepstakes. To complete your entry in the Sweepstakes, submit up to five (5) e-mail addresses per day of any friends that you think will be interested in the Sweepstakes. For every friend you refer that subsequently enters the Sweepstakes, you will receive one (1) entry for you and your referred friend to share. You may not refer a friend more than once. All multiple entries submitted by the same entrant and referred friend will be disqualified. Please note, if your friend has previously opted-out of receiving emails from Sponsor, he/she will not receive your referral email. You may also enter this Sweepstakes by hand printing your first name, last name, address, city, state, zip code, date of birth, telephone number, email address, the Share your Cold-EEZE phrase above, and your three travel companions’ (who will accompany you on the Grand Prize trip if you were to win) names, cities and states where they reside on a 3” X 5” paper and mail the paper to: Share Your Cold-EEZE Sweepstakes, P.O. Box 7979, Melville, NY 11775-7979. All mailed entries must be postmarked by February 28, 2009 and received by March 7, 2009. All eligible mailed entries will receive five (5) entries per envelope. Use of computer programs and other automatic means to enter Sweepstakes is prohibited. Normal Internet access and usage charges imposed by your on-line service will apply.

3. RANDOM DRAWING: One entry will be selected in a random drawing on or about March 13, 2009, from among all eligible entries received. The drawing will be conducted by Don Jagoda Associates, Inc., an independent judging organization whose decisions are final and binding in all matters relating to the Sweepstakes. Odds of winning depend on the total number of eligible entries received. The selected entrant and his/her referred friend (if applicable) will be notified by e-mail/mail within fourteen (14) days of the drawing. Both the entrant and referred friend (if applicable) will be required to sign and return an Affidavit of Eligibility, Liability Release, and where legal, a Publicity Release within fourteen (14) days of notification attempt, at which time, they will be deemed Winner(s) (“Winner(s)”). Winner(s) must comply with all terms and conditions set forth in these Official Rules. Noncompliance within this time period will result in disqualification of the entry and an alternate entry selected at random from all eligible entries received. If prize notification is returned as non-deliverable, the entry will be disqualified and an alternate entry will be selected.

4. PRIZE AND APPROXIMATE RETAIL VALUE (“ARV”): One (1) Grand Prize: A 7-day/6-night trip for four (4) to Maui, Hawaii. Trip includes round trip coach air transportation for four (Online entry - Winners and one guest for each winner or Mail-in entry - Winner and three travel companions listed on his/her entry) from a major airport closest to the selected entrant’s home city to Maui, Hawaii, six (6) nights Sponsor-selected hotel accommodations (2 rooms based on double occupancy) in Maui, Hawaii; use of a mid-size car rental for seven (7) days in Maui, Hawaii. Winner(s) and guests must travel on same air itinerary. All travel arrangements are at the sole discretion of the Sponsor and are subject to availability. ARV: $11,000.

Prize is nontransferable and must be accepted as awarded. No cash or other substitution may be made, except by Sponsor in the event that the prize (or portion of prize) cannot be awarded for any reason, in which case, Sponsor will award a prize of equal or greater value. All taxes, fees and surcharges on prize are the sole responsibility of Winner(s).

5. ELIGIBILITY: Open to legal U.S. residents, who have valid U.S. drivers’ licenses, and are 21 years of age or older as of date of entry. Employees of The Quigley Corporation, their parents, subsidiaries, affiliated companies and agents, Empathy Lab, Inc. and Don Jagoda Associates, Inc. and the immediate family (defined as parents, spouse, children, siblings, grandparents) of each such employees, and all those with whom such employees are domiciled, are NOT eligible. 6. GENERAL RULES: Airline carrier's regulations and conditions apply. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Guests (or parent/legal guardian, if guests are minors) will be required to execute a Release of Liability prior to departure. If any guest is a minor, he/she must have his/her parent/legal guardian accompany him/her on the trip. Winner(s) and guests must possess valid travel documents (i.e., valid photo ID) in order to travel. Airline seat selection and timing of trip subject to availability and confirmation of reservations. No refunds or credit for changes are allowed. All travel must be completed within one (1) year of prize award. Certain restrictions and blackout dates apply. Car rental is subject to additional restrictions set forth by the car rental contract. If Winner(s) does/do not meet car requisites/requirements, that portion of the prize will not be awarded and no additional compensation will be provided. Winner(s) is/are responsible for returning the car with a full tank of gas. Winner(s) is/are responsible for arranging all insurance and liability with the car rental agency upon pick-up of car rental. Winner(s) is/are responsible for any damage to the car rental during the trip. All other expenses and costs, not expressly listed above, including, but not limited to, taxes, tips, entertainment, transfers, and transportation between the airport and Winner(s)’/guests’ home residences are the Winner(s)' sole responsibility. In the event the Winner(s) or guests engage in behavior that (as determined by Sponsor, in Sponsor’s sole discretion) is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip or other applicable experience early, in whole or in part, and send the Winner(s) and guests home with no further compensation. A 1099 tax form will be submitted on Winner(s)’ behalf by Sponsor for the actual value of the prize awarded, and if applicable, to be split evenly between Winner(s). By accepting the prize, Winner(s) agree(s) that the Sponsor and those acting under the Sponsor's authority, may use Winner(s)’ names, pictures/portrait likeness and/or voices, for advertising and promotional purposes without further consideration, unless prohibited by law. Entrants agree to be bound by these Official Rules and the decisions of the judges. BY ACCEPTING THE PRIZE, THE WINNER(S) AGREE(S) THAT THE SPONSOR, ITS SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF THE SPONSOR'S OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY WINNER(S) FOR ANY LIABILITY, FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY DAMAGES SUSTAINED, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS SWEEPSTAKES OR PARTICIPATION IN ANY SWEEPSTAKES OR PRIZE RELATED ACTIVITY. All entries become the sole property of Sponsor and none will be returned. In the event of a dispute, entries made by Internet will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Each potential Winner may be requested to provide Sponsor with proof that he/she is the authorized account holder of the e-mail address associated with the winning entry. If for any reason the Sweepstakes is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes and award prize from among all eligible entries received prior to cancellation or termination.
